DAYTON, Ohio — A man who was shot by Dayton police during a Labor Day incident at Samaritan Behavioral Health CrisisCare Emergency Room now faces charges.

Cory A. Fraley was charged with aggravated robbery.

The 38-year-old Toledo-area man reportedly lunged at police and reached for an officer’s gun before he was shot.

Any additional charges will reportedly go to a grand jury.

Dayton police identified a man shot by an officer in a Labor Day incident during a press conference Tuesday.

Cory Allen Fraley, 38, of Toledo, was shot in the hip at Samaritan Behavioral Health CrisisCare Emergency Room Monday morning after reportedly lunging for an officer’s gun twice.

During the press conference, Dayton Police Chief Richard Biehl reported that Fraley made multiple comments about wanting his life to end during two incidents Monday.

While at an RTA hub where Fraley asked for directions to Gateway Men Shelter and commented that he “is ready to die,” according to video surveillance.

Though he asked for directions to the shelter, Fraley got off the bus at the Samaritan Behavioral Health.

Once at the health center, he reportedly told staff that he wanted a gun to end it all.

Officers David Blackburn and Timothy Liddy responded to the scene on a mental health call around 8:26 a.m.

Samaritan video surveillance showed Fraley lunging out of frame at officers twice before they both deployed their Tasers.

Fraley did not react to the Tasers and began to lunge for one of the officer’s gun.

After the second attempt, Fraley was shot.

Approximately four minutes elapsed from the officers’ arrival on scene to the shooting.

Biehl said that officers exercised great restraint and tried all other measures.

Fraley was taken to an area hospital where is he still being treated.

While Fraley has no arrests or convictions in Dayton, his record in Hancock County includes assault, forgery, trespassing, domestic violence, theft, receiving stolen property and trafficking/possession of drugs (marijuana and cocaine).

According to Biehl, Fraley was in Toledo Friday and it is not known why was he was in Dayton Monday.


Dayton police are expected to release new details surrounding the police shooting at the Samaritan Behavioral Health CrisisCare during a 3:30 p.m. press conference Tuesday.

The shooting happened around 8:30 a.m. Monday.

Dayton police shot a 38-year-old Toledo area man in the hip Monday morning at the Samaritan Behavioral Health CrisisCare Emergency Room after he became violent, Police Chief Richard Biehl said.

“He was volatile, violent and there was an effort to use a Taser,” said Biehl, who noted it appeared the man might have been coming off methamphetamine.

Biehl said the man, who was not armed, made a “lunging movement toward the officer’s weapon” before he was shot.

Officers initially were dispatched to the facility, in the 600 block of Edwin C. Moses Boulevard, after receiving a mental health call, Biehl said. Additional police units were requested around 8:30 a.m., police said.

A Dayton police report filed Monday morning indicated police arrested Cory Fraley at the same location of the shooting, however Fraley was still not in jail Tuesday afternoon.

However, police have not made clear whether Fraley is the man wounded by police.

Two Dayton officers responded to the initial call and one of those officers fired a shot that struck the man in the hip, the chief said. The man’s injuries are not believed to be life threatening, the chief said.

Both officers will be placed on paid administrative leave, which is standard protocol following an officer-involved shooting. The officers’ names are expected to be released Tuesday.

Biehl said there is not much local history on the suspect. The police department is checking across the state for any previous law enforcement activity.

Edwin C. Moses Boulevard was blocked from Washington to Albany streets while police investigated.
