An officer with the Midlothian (IL) Police Department responding to a call of shots fired at a bar allegedly shot and killed an armed security guard on Sunday morning, not the alleged shooter, according to WGN-TV.

Now, the family of 26-year-old Jemel Roberson has filed a lawsuit seeking damages of more than $1 million, according to Fox News.

According to reports, Roberson had told a group of “drunk men” to leave the bar at around 0400 hours on Sunday. One of the men reportedly returned and opened fire. Witnesses said that Roberson apprehended the suspect and requested help from Midlothian police.

Arriving officers found Roberson holding the subject to the ground, allegedly with his gun drawn.

At least one of the responding officers opened fire, fatally wounding Roberson.
